Terms & Conditions

Provided that any reserve has been attained and any deposit required be paid immediately thereafter the highest bidder shall be the purchaser and upon the fall of the hammer shall be bound by these terms and conditions of sale. The Auctioneers decision shall be final and if cannot decide who was the last and best bidder he may resubmit the lot. The Auctioneer reserves the right to accept or reject a bid at his discretion and at any time to withdraw any lot from sale. If required by the Auctioneer, a cash deposit 10% or $500.00 which ever being the greater amount of each lot, must be paid forthwith upon the fall of the hammer. Unless prior credit arrangements have been made with the Auctioneer, all purchasers must be completed in cash and lots removed from the Auctioneer’s premises before noon on the business day following the auction. If any purchase is not so completed any deposit shall be forfeited and the Auctioneer may terminate the sale and thereafter resell the lot and the deficiency if any, arising on such resale and all expenses of an incidental to such resale or attempting resale and the purchase default shall be recoverable by the Auctioneer as liquidated damages. If delivery is made prior to payment, title will not pass until payment is received and in the case of a cheque, it has been collected. Each lot is sold subject to all faults and defects disclosed by the Auctioneer. The Auctioneer gives no guarantee as to the correctness of his description on any lot, including its stated Year model. Each lot will be at the purchaser’s risk in all respects from the instant it leaves the Auctioneer’s premises. Each lot submitted by the Auctioneer (Excluding commercial vehicles or any Vehicle registered within 28 days) is subject to a “ROADWORTHY CERTIFICATE” at the time of delivery. If these conditions cannot be met “ALL” monies will be refunded in full or transferred to another vehicle purchased.
